Brimhall proceedings continue


Jonesboro, AR – (JonesboroRightNow.com) – Aug 23, 2024 – Prosecuting Attorney Doug Brimhall has found himself on the opposite side of a legal battle than what he is accustomed to.

Usually representing clients as a lawyer and prosecutor, the 40-year-old is listed as the defendant in several recent proceedings.

First reported by JonesboroRightNow when the incident happened in May, Brimhall was charged with Aggravated Assault on a family or household member, as well as Domestic Battery in the 3rd degree. The defendant has pleaded not guilty to both charges.

Since then, a litany of entries have been filed in the case including the recusal of all twelve Circuit Judges, multiple motions, notices, and discovery documents.

The last document was filed on Aug 15 and includes a motion filed by Brimhall’s attorney regarding production of records. Additionally, NEA Report stated that these documents “seek to bar certain terms from being used in the trial process, including ‘future judge,’ ‘judge-elect,’ and ‘lawyer.'” Brimhall also asked the court to prohibit statements, articles, or assertions posted by news media or on social media to be mentioned in court, stating that these statements, articles, or assertions would constitute hearsay.

This motion has not yet been granted or denied.

In related court filings, Brimhall’s ex-wife, Lark Montgomery has filed for guardianship of the alleged victim in the May 3 incident. The petition for guardianship was filed on June 3 and granted on June 21.

Stipulations of the guardianship include child support and no contact with the minor until several conditions are met:

  • Respondent (Doug Brimhall) shall complete a drug/alcohol assessment
  • Respondent (Doug Brimhall) shall wear an alcohol monitoring device for a minimum of 6 months or longer if required by the device with and reports or violations being submitted to the petitioner
  • Respondent (Doug Brimhall) shall attend and complete an anger management program

The petition was signed by Circuit Judge Kathleen Bell who was appointed as a special Judge to the case after 12 recusals.
